WARN Act rules in Maine

Maine has its own layoff notice law on top of the federal WARN Act, the Maine Severance Pay Act. An employer has to satisfy both, so the stricter rule is the one that applies to you.

Notice required
90 days
Employers covered
Any facility that employs or has employed 100 or more people at any time in the preceding 12 months.
What triggers notice
A permanent closing, a relocation of substantially all operations 100 or more miles away, or a mass layoff affecting at least 500 employees or at least 50 who are 33 percent of the workforce.
Statute
26 M.R.S. 625-B
If an employer does not comply
Up to $1,000 per affected employee for failure to pay severance, plus $500 per day for failure to give notice.
Administered by
Maine Department of Labor, Bureau of Labor Standards

How Maine differs from federal WARN

Maine requires 90 days notice for a closing or relocation rather than the federal 60, and requires severance pay of one week per year of service to employees with at least 3 years of service, which federal WARN does not.

Federal WARN, for comparison, covers employers with 100 or more employees and requires 60 days notice.
