WARN Act rules in New Jersey

New Jersey has its own layoff notice law on top of the federal WARN Act, the Millville Dallas Airmotive Plant Job Loss Notification Act. An employer has to satisfy both, so the stricter rule is the one that applies to you.

100 or more employees, counting both full-time and part-time, with no minimum service or hours requirement.
What triggers notice
A termination or transfer of operations, or a mass layoff, terminating 50 or more employees at or reporting to the establishment in any 30-day period.

If an employer does not comply
Severance of one week of pay per full year of employment, plus an additional four weeks of pay if the required 90 days notice was not given.

How New Jersey differs from federal WARN

New Jersey requires 90 days notice rather than 60, counts part-time employees toward both coverage and the trigger, uses a flat 50-employee trigger with no percentage test, and mandates severance pay even when full notice is given.

Federal WARN, for comparison, covers employers with 100 or more employees and requires 60 days notice.
